On 12 June 2024, organisers Dragana Damjanovic (TU), Iris Eisenberger (University of Vienna) and Verena Madner (WU) hosted the fourth edition of the Vienna Law Salon. <\/p>\n\n\n\n
German legal scholar Franz Reimer was invited as a guest speaker and gave a lecture entitled \u2018Sufficiency \u2013 a path for environmental law?\u2019 <\/p>\n\n\n\n
Suffizienz \u2013 ein Begriff, der auch mit \u201eVerzicht\u201c umschrieben werden kann \u2013 sei ein \u201ealter Hut\u201c, hielt Franz Reimer<\/em>\u00a0am Beginn seines Vortrages fest. Schlie\u00dflich begegne sie einem bei Alltagssituationen wie dem Eco-Sp\u00fclmaschinenprogramm, das aufgrund einer EU-Richtlinie bereits als Standardprogramm voreingestellt ist, um Energie und Wasser zu sparen. Ausgehend von dem Gedanken, dass die Erde \u00f6kologischen Belastungsgrenzen (sogenannten planetaren Grenzen) unterliegt, widmete sich\u00a0Franz Reimer<\/em>\u00a0based his reflections on the idea that the Earth is subject to ecological limits (known as planetary boundaries). \u2018Because nothing is more practical than a good theory,\u2019 he noted with a wink.\u00a0<\/p>\n\n\n\n The first point dealt with the suitability of sufficiency as a technical term. Even if the political debate about renunciation is an uncomfortable one, a little renunciation in the here and now could be better than an otherwise necessary radical renunciation in the future. Franz Reimer<\/em> also pointed out that laws generally have a core of sufficiency, as they usually restrict the scope for behaviour. <\/p>\n\n\n\n The discussion then turned to the challenges inherent in sufficiency as a regulatory strategy. Among the political problems is the lack of social acceptance for renunciation, which\u00a0Franz Reimer<\/em>\u00a0am Beispiel eines m\u00f6glichen Tempolimits in Deutschland illustrierte. Als kulturelle Problematik f\u00fchrte er an, dass Suffizienz in pers\u00f6nliche Lebensbereiche eingreife und stellte die demonstrative Frage, ob eine Kreuzfahrt f\u00fcr viele Menschen nicht Teil eines erf\u00fcllten Lebens sei. Zu den rechtlichen Implikationen f\u00fchrte\u00a0Franz Reimer<\/em>\u00a0explained that although no obligation to sufficiency can be derived from the existing (German) legal framework, the promotion of sufficiency is not prohibited either.\u00a0<\/p>\n\n\n\n Anschlie\u00dfend fasste er zusammen, dass Suffizienz eine sinnvolle bzw. in Hinblick auf die Umwelt und den Klimawandel sogar notwendige Regelungsstrategie sei, aber gleichzeitig soziale und \u00f6konomische Probleme mit sich bringe. Daher k\u00f6nnte Suffizienz als \u201eBr\u00fcckenstrategie\u201c gedacht werden, die nur tempor\u00e4r gilt, bis etwa die technologischen M\u00f6glichkeiten ausreichen. Schlussendlich sprach sich\u00a0Franz Reimer<\/em>\u00a0also advocated that dogmatics should not only be pursued from a \u2018normal perspective,\u2019 but also with regard to the major challenges of climate change.\u00a0<\/p>\n\n\n\n The highly informative and equally incisive presentation ended with a lively discussion. Topics included the relationship between sufficiency and sustainability, as well as measures to mitigate potential social consequences.
